The North Adams Zoning Board of Appeals will hold a meeting via teleconference on Monday, June 15, 2020, at 7:00 p.m.

Pursuant to Governor Baker’s March 12, 2020 Order Suspending Certain Provisions of the Open Meeting Law, G.L. c. 30A, §18, and the Governor’s March 15, 2020 Order imposing strict limitation on the number of people that may gather in one place, this meeting of the City of North Adams Zoning Board of Appeals will be conducted via remote participation to the greatest extent possible. Specific information and the general guidelines for remote participation by members of the public and/or parties with a right and/or requirement to attend this meeting can be found on the City of North Adams website, at http://www.northadams-ma.gov/index.php?nav_id=13. For this meeting, members of the public who wish to listen to the meeting may do so in the following manner: https://us02web.zoom.us/j/89846936389. No in-person attendance of members of the public will be permitted, but every effort will be made to ensure that the public can adequately access the proceedings in real time, via technological means. In the event that we are unable to do so, despite best efforts, we will post on the City of North Adams website an audio or video recording, transcript, or other comprehensive record of proceedings as soon as possible after the meeting.

• Case No: Z2020-02 Request by Berkshire Hills Development Co, LLC for waivers of strict compliance of the Off Street Parking Requirement pursuant to Section 6.9 of the Zoning Bylaw for property located at River and Veazie Streets in a B-1 and B-2 zone.

REGULAR MEETING

MINUTES

June 15, 2020

Members present Chairman Ross Jacobs, Paul DiLego, Jr., Peter Milanesi, and Gregory Roach

Members absent Donald Pecor, Jr. and Christopher Thomas

Other members present virtually Jeff Grandchamp, Berkshire Hill Development Co, LLC

Call to order Chairman Jacobs called the meeting to order at 7:02 p.m. The secretary called the roll.

Chairman Jacobs read the following statement regarding virtual meetings:

Pursuant to Governor Baker’s March 12, 2020 Order Suspending Certain Provisions of the Open Meeting Law, G.L. c. 30A, §18, and the Governor’s March 15, 2020 Order imposing strict limitations on the number of people that may gather in one place, this public hearing of the North Adams Zoning Board of Appeals is being conducted via remote participation. No in-person attendance of members of the public will be permitted, but the public can listen to this meeting while in progress by via teleconference at zoom.us. Members of the public attending this meeting virtually will be allowed to make comments if they wish to do so, during the portion of the hearing designated for public comment, by teleconference.

Chairman Jacobs read the Zoning Board Chairman’s statement:

Any application for a variance or a special permit may be withdrawn by the petitioner without prejudice by requesting this Board’s permission to do so. This request by the petitioner must be made prior to any vote or final action by the North Adams Zoning Board of Appeals. Any variance or special permit request so withdrawn may be re-submitted at a future time by repeating the application process. Any variance or special permit request which is unfavorably and finally acted upon may not be re-submitted for a period of two years from this date unless this Board agrees by vote that the new request is substantially different than the first one.

Approval of minutes Chairman Jacobs requested a motion to approve the minutes from October 21, 2019.
Member Milanesi made a motion to approve the minutes. Member DiLego seconded the motion. All in favor. Motion passes.

New business
• Case No: Z2020-01 Application of Berkshire Hills Development Co, LLC for property located at River and Veazie Streets. Special permit requested for parking not on same lot as the use the parking serves (reconfiguration of parking) in a B-1 and B-2 zone.
• Case No: Z2020-02 Request by Berkshire Hills Development Co, LLC for waivers of strict compliance of the Off Street Parking Requirement pursuant to Section 6.9 of the Zoning Bylaw for property located at River and Veazie Streets in a B-1 and B-2 zone.

Chairman Jacobs opened the meeting to Jeff Grandchamp. Mr. Grandchamp explained that they are reconfiguring the parking plan to improve traffic flow and centralize all of the parking. There is an increase of one parking space. They have received approval from the Conservation Commission and the Planning Board. In regard to the waivers, they think that it will look the same or consistent with the rest of the neighborhood and there will be adequate room for plantings which they intend to maintain.

Chairman Jacobs inquired about whether abutters had been notified. The secretary confirmed.

Member Milanesi inquired about the overflow parking in Sunshine Park as indicated on the parking plan. Mr. Grandchamp stated that it wasn’t necessary for their usage.

Chairman Jacobs inquired about whether any further construction is required to finish the lot such as paving or grading. Mr. Grandchamp stated that only paving and grading would be needed. There were some catch basins that he thinks have already been installed.

Member Roach inquired about whether they would close the curb cut between 245 and 243 River Street. Mr. Grandchamp stated that that would be left for emergency access purposes.

Chairman Jacobs requested a motion on both cases. Member Milanesi made a motion to grant the special permit to Berkshire Hills Development Co, LLC subject to the following conditions:

1. This special permit goes with the applicant Berkshire Hills Development Co, LLC for property located at River and Veazie Streets.
2. The special permit is for parking not on same lot as the use the parking serves.
3. The site will be reviewed in six (6) months to be sure the conditions are being complied with.
4. Any revisions to the plans submitted and accepted by the Zoning Board at the meeting held June 15, 2020 would require review and approval of the Board.
5. This special permit shall lapse on June 17, 2022 if it has not been exercised by that date, except for good cause.
6. This special permit must be filed at the Registry of Deeds (Registry of Deeds Document) within thirty (30) days after being certified by the City Clerk’s Office.

Member Milanesi would also vote to approve all of the waivers. Member DiLego seconded the motion. All in favor. Motion passes. The waivers and special permit are granted.

Adjournment Meeting adjourned 7:13 p.m.
